A Seat Can’t Be Declared Vacant Because An MP Decides To Go Independent – John Boadu

Concern is mounting across the nation due to increasing political tension within the New Patriotic Party (NPP), with reports indicating that a significant portion of party members is considering running as independent candidates in the forthcoming parliamentary elections.

In a recent interview, John Boadu, the ex-General Secretary of the NPP, revealed that 30 to 40 notable members are indicating their desire to split from the party.

Boadu expressed concerns about this development, referring to it as a worrisome indication of division within the party at the constituency level.

Speaking to Mac Jerry Osei Agyemang on Neat 100.9 FM. He affirmed that his knowledge came from reliable internal sources, suggesting that these individuals are poised to defect as a result of persistent grievances and misunderstandings within their respective communities.

“This is based on concrete information,” emphasized Boadu. There are clear signs that a potential 40 NPP Members of Parliament intend to run as independent candidates in the forthcoming elections.

The issue extends beyond the three MPs that have been the recent focus of attention. During his interview, Boadu also discussed a legal issue concerning the status of MPs who decide to run as independent candidates.

He emphasized that a Member of Parliament’s seat cannot be deemed vacant solely due to their decision to run as an independent candidate.

Per his statement, the constitution requires that a formal notice must be provided to the Speaker of Parliament, either by the MP or the party’s national leaders, prior to any steps being taken with regards to the seat.

“The constitution explicitly states that a seat cannot be deemed vacant solely because an MP chooses to become independent. Boadu emphasized the necessity for the Speaker to be officially notified by either the MP or the party’s leadership before any action can proceed.

This highlights the intricate decision-making process that MPs must navigate.
